In Denmark, German companies must register their employees in the “RUT” register for foreign service providers (Register for Foreign Service Providers - Registret for Udenlandske Tjenesteydere). The posting regulations and forms can be found in German on the Workplace Denmark website operated by the Danish authorities.
Important: Not all services are reportable; the exceptions are listed in a RUT registration guide. This includes, for example, in-house secondments and participation in seminars and conferences. The fitter clause is also described here, according to which work on technical systems for up to eight days is not subject to the reporting requirement.
The process of posting notifications in Denmark:
- Go to the “RUT” registration page on the official Danish government website “Virksomhedsguiden” (https://indberet.virk.dk/myndigheder/stat/ERST/Register_Fr_auslndische_Dienstleister_RUT).
- Click Start and create a user account if you don't already have one.
- Fill out the registration form, in which you provide your company details and details of the employees you are posting to Denmark.
- Include required documents, such as employment contracts and payslips.
- Check all details and submit your registration.
- You will receive a confirmation by email and can view your registration in the portal.
Note that not all services are reportable and that there are exceptions. These are listed in a RUT registration guide, which can be found on the Danish authorities' “Workplace Denmark” website (https://workplacedenmark.dk/de/about-workplacedenmark/).
